Background and Definitions
- “VoiceSage” is the name given to the communications service provided by the electronic network, hardware infrastructure and software that is in the control of VoiceSage Global Holdings DAC -T/A VoiceSage DAC (The Company).
- The VoiceSage Acceptable Use Policy (AUP) defines acceptable and unacceptable use of VoiceSage by those who have been provided access to the VoiceSage service.
- The Company Acceptable Use Policy applies in the first instance to any organisation authorised to use VoiceSage (a “User Organisation”). It applies also to the use of VoiceSage by the User Organisation’s own members and all those to whom it otherwise provides with access to VoiceSage (collectively, its “Members”).
- It is therefore recommended that each User Organisation establishes its own statement of acceptable use within the context of the services provided to its Members, and in a form that is compatible with the conditions expressed in the Company Acceptable Use Policy. Such a statement may refer to, or include, this document. If material from this document is included, this must be done in such a way as to ensure that there is no misrepresentation of the intent of the Company Acceptable Use Policy. The VoiceSage Service Desk can advise on this aspect as and where necessary.
- Use of VoiceSage by a User Organisation constitutes acceptance and agreement to the Company’s AUP as well as the Company’s General Terms and Conditions. VoiceSage may amend or update the AUP from time to time without prior notice.
- A violation of this AUP by you the Client, may result in the suspension or immediate termination of your VoiceSage account WITHOUT PRIOR NOTICE.
Acceptable Use
- A User Organisation and its Members may use VoiceSage for the purpose of communicating with other User Organisations and their Members, and with organisations, individuals and services attached to networks which are reachable via VoiceSage. All use of VoiceSage is subject to the VoiceSage Terms and Conditions.
- Subject to clauses 8 to 21 below, VoiceSage may be used by a User Organisation and its Members for any lawful activity that is in furtherance of the aims and policies of the User Organisation. (Note 1)
- It is the responsibility of the User Organisation to ensure that its Members use VoiceSage services in accordance with this VoiceSage Acceptable Use Policy, and with the current legislation and the appropriate regulatory body. (Note 2)
Unacceptable Use
The following will constitute violations of the VoiceSage Acceptable Usage Policy by a User Organisation or its Members for any of the activities described below and (Note 3):
- Illegal Purposes – VoiceSage may not be used for illegal purposes, or in support of illegal activities, or transmission of any offensive, obscene or indecent images. VoiceSage reserves the right to notify and/or cooperate with law enforcement authorities, regulatory authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
- Harm to minors – Use of the VoiceSage to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.
- Threats – Use of the VoiceSage to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
- Harassment – Use of the VoiceSage to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another person or party.
- Fraudulent Activity – Use of VoiceSage to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as, but not limited to “pyramid schemes,” “Ponzi schemes,” and “chain letters”.
- Forgery or Impersonation – Adding, removing or modifying identifying network header information in an effort to deceive or mislead a person or party is prohibited. Attempting to impersonate any person or party by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
- Unsolicited commercial e-mail / unsolicited bulk e-mail (SPAM) – Use of the VoiceSage to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending VoiceSage account.
- E-Mail / News Bombing – Malicious intent to impede another person or party’s use of electronic mail services or news will result in the immediate termination of the offending VoiceSage account.
- E-Mail / Message Forging – Forging any message header, in part or whole, of any electronic transmission, originating or passing through the VoiceSage service is in violation of this AUP.
- Usenet SPAMing – VoiceSage has a zero tolerance policy for the use of its network for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.
- Unauthorised Access – Use of VoiceSage to access, or to attempt to access, the accounts of other persons or parties, or to penetrate, or attempt to penetrate, security measures of VoiceSage’s or another person or party’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending VoiceSage account is subject to immediate termination. Continuing to use a VoiceSage infrastructural item after being requested to cease use as the item is causing disruption to the VoiceSage production services.
- Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property – Right Use of VoiceSage to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorised copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorised transmittal of copyrighted software.
- Collection of Personal Data – Use of VoiceSage to collect, or attempt to collect, personal data or information about third parties without their knowledge or consent in breach of data protection laws.
- Network disruptions and unfriendly activity – Use of VoiceSage for any activity which affects the ability of other people or systems to use VoiceSage Services or the Internet. This includes “denial of service” (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the User Organisation responsibility to ensure that their network is configured in a secure manner. A User Organisation may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A User Organisation may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorised entry and/or use of another company and/or individual’s computer system will result in immediate account termination. VoiceSage will not tolerate any User Organisation attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
Passing on and Resale of VoiceSage Service
- A User Organisation may not extend VoiceSage access to other individuals unless it has written permission to do so from an authorised VoiceSage representative.
Compliance
- It is the responsibility of the User Organisation to take reasonable steps to ensure its Members’ compliance with the conditions set out in this Policy document, and to ensure that unacceptable use of VoiceSage is dealt with promptly and effectively should it occur. The discharge of this responsibility includes informing all Members.
- Where necessary, service may be withdrawn from the User Organisation, in accordance with the VoiceSage Terms. Where violation of these conditions is unlawful, or results in loss or damage to VoiceSage or VoiceSage resources or the resources of third parties relating to VoiceSage, the matter may be referred for legal action.
Explanatory Notes
- Use by the User Organisation and its members may be in pursuance of activities for commercial gain as well as for not-for-profit activities, provided such activities remain in accordance with the aims and policies of the user organisation.
- It is preferable for misuse to be prevented by a combination of responsible attitudes to the use of VoiceSage resources on the part of its users and appropriate disciplinary measures taken by their User Organisations.
- The list of unacceptable activities in this section is not necessarily exhaustive. In accordance with clause 8, the use of VoiceSage for any activity which may reasonably be regarded as unlawful is not permitted. The purpose of this section is to bring as clearly as possible to the reader’s attention those activities most commonly associated with the abuse of a network
